Visitor Acknowledgment of Risk
In consideration of the services of GreatDanePhotos, DBA Focused Wild Photo Adventures, their officers, agents, employees, and stockholders, and all other persons or entities associated with those businesses (hereafter collectively referred to as “Focused Wild”); I agree as follows:
Although Focused Wild has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, Focused Wild has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Focused Wid does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks.
Risks include falling, falling rocks, getting lost, traveling on rough or uneven terrain, traveling through snow and freezing conditions, stream crossings, possible highway crossings, insect and animal bites, forces of nature such as lightning strikes, absence of prompt medical attention, if needed, and travel by automobile or other conveyance, including on active logging roads and other unpaved surfaces, which may result in personal injury or sickness including minor injuries such as scratches, bruises, and sprains, major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions, catastrophic injuries including paralysis and death.
I am aware that participation in photography workshops entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary; no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks.
I also understand that travel with a group invariably involves compromise to accommodate the diverse desires, travel goals, personalities, and physical abilities of group members, and that itineraries are not guaranteed and are only a guideline.
In addition, I agree that I am personally responsible for providing and wearing appropriate clothing, footwear and/or safety gear, my dietary needs, and that I am in sufficiently good physical and psychological health to undertake Focused Wild activities, and certify that I do not knowingly have any medical or health considerations that could create a risk for me or other participants. I understand that instructors may not possess the required training or equipment to handle incidents that may occur. In case of injury, accident, illness, or my inability to complete these activities, I will bear the full cost of any additional transportation or evacuation procedures performed by Focused Wild or others. I certify that I am voluntarily participating in these Focused Wild activities and assume all risks, consequences, and potential liability for this participation.
I acknowledge that engaging in this activity may require a degree of skill and knowledge different from other activities and that I have responsibilities as a participant. I acknowledge that the staff of Focused Wild has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity.
I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death, or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.
I acknowledge that certain transportation services, guide services, accommodations, vehicle hire firms, outfitters, or other service providers used by Focused Wild in the course of our workshops require clients agree to standard operating terms which limit their liability. When such services not owned or affiliated with Focused Wild are used as part of a Focused Wild workshop package, I am bound by that service provider’s standard terms and conditions with respect to my legal relationship to the owners and operators of the service, their agents and the service provider’s staff.
I acknowledge that Focused Wild does not maintain control over the personnel, equipment, or operations of these suppliers, and I release Focused Wild so that it cannot be held liable for, among other things, any personal injury, death, property damage, or other loss, accident, delay, inconvenience, irregularity of (1) wrongful, negligent, willful, or unauthorized acts or omissions on the part of any of the suppliers, or other employees or agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated, or otherwise by any of these suppliers, or (3) any wrongdoing, willful, or negligent act or omissions on any part of any other party. This includes cancellations of transportation, including flights, and hotels.
I have carefully read, clearly understood, and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon me, my heirs, assigns, personal representative, and estate and for all members of my family, including minor children.
